Need Some Advice....

Hi everyone. You may have seen in some other posts around here that I just took the ASTB, got competetive scores and am ready to submit my package. However, I do have a problem. I used the search function and found a similar conversation on here that happened in June, mine is a little different.

Back in December of 2004, my uncle filed a protection order against me because when we got into a heated family arguement (over a death in the family) I threatened to kick his @ss. There was no physical violence, or any history of the sort. The case was civil, not criminal. The judge ordered a 1 year protection order. The year passed without violation of the order, and there has been no contact between him and I since.

I have no criminal record, no DUI / DWI's, no traffic violations since 2001, and held a Navy Secret Security Clearance at the time of the incident, and it was not revoked.

I have contacted an attorney about trying to get the documents exponged, but it may not be able to get done. Do you guys think this will be a big deal in the application process since 3 years have passed with no trouble??

The thing that sucked about it was that I could not appeal the judges decision since I was home on leave from VRC-30 Det 5 in Japan, and that was when the Tsunami hit Southeastern Asia and my Det was tasked with relief effort, I had to go back ASAP!

What do you guys think??

Probably not a big deal. Just be frank when the time comes to do your security clearance. Also, forget about getting it expunged, as this will not prevent DONCAF/DSS from seeing it during an SSBI.

Having personal experience with this, the Lautenburg act restrictions on you should be over, (no guns) which would be the only sticky part with the Navy.

Admit to it.. And expunging would not help. My ex got a 90 day one on me, just by crying in court.

It is the permanent ones you need expunged for Lautenburg bullshit.

Yeah, mine was a 1 year protection order. I didn't have a concealed weapons permit or a gun at the time, so it wasn't an issue. Now the protection order has been expired for 2 years. I actually was assigned a recruiter earlier today and explained the situation to him. He said it wasn't a show stopper and to just fully explain it on the application. Thanks guys.
