More correctly than some of the above...the Tenth Amendment to the Constitution...don't make it harder than it has to be.

Well, since states set the age for legal drinking, albeit under considerable duress from the Feds, it is, by definition, a state matter. I don't think you'll find any Federal legislation dealing with legal drinking age.

Basically, the federal government strong armed the states into upping the age to 21 for purchase of alcohol by withholding tax dollars for highways if they failed to comply.

The Constitution delegates very specific powers to the U.S. Government. Authority over other issues is vested in the State.

Hence the aforementioned "considerable duress." If memory serves, states could opt out with a penalty of losing a portion of Federal highway funding. Not surprisingly, none did, but I don't think you'll ever see anyone prosecuted at the Federal level for a violation of that legislation.

Okay, I've been pondering this one for a few days...probably because if this act would have taken place when my husband was enlisted I would have asked it. lol. Anyhow, spouses, they attend the functions such as the Marine Corps Ball- would that mean that their spouse would now be able to be responsible for them to drink at that social event as well since they're are allowed? Hey, I would have asked if I was a spouse!! lol.
