True, but there is a chance that the aircraft turning final never saw the other aircraft below. I mean, even turning final the other aircraft would have been out of the pilot's view. It seem that the other aircraft was directly below. Maybe the lower aircraft should have seen the other since it seems he crept up from behind, either way parallel approaches require some stiff SA.Simply blaming the tower is a cop-out. While they could have played a role, we don't have enough info about what really happened to reach that conclusion. In the end, VFR is VFR thus see and avoid applies, especially in a busy pattern environment. A good lookout doctrine can help prevent stuff like this. There was a pretty nasty (but non-fatal) Prowler class A which resulted from two jets from the same division break attempting to land on eachother.
