She gets immunity from everything, while he is taken to court martial, is found innocent, and still gets punished.

The sad fact is, it isn't the first time this has happened either. While I was there we had a female in my company that was caught in the act with another mid. He claimed consensual, she claimed rape. The rape could never be proved, but sex in the hall is a no-no, so guess what? She stayed because they couldn't prove she wasn't raped, and he got the boot because either way he broke the rules.

It's all bullsh*% and the whole USAFA thing didn't help either. When I detailed, every female plebe who quit was interviewed very pointedly about whether it was sexual harrasment that caused them to quit. Indications are the officer who conducted the interviews essentially was leading them to say that harrassment was the reason they quit. She was as worthless an officer as I've ever seen, and none of us appreciated the insinuation that we were incapable of training the 4/C in a professional manner.

But he's finished isn't he? I mean he finished the schooling, so he can take all of that and at least get his degree somewhere else. While I don't exactly feel sorry for him, he was still breaking rules, I find it appalling that he is the only one possibly getting punished. Considering the command climate it seems obvious that he will be punished in some way. Not to mention that, as the convening authority, the Supe can overturn the findings of the Court Martial to some degree, I believe.

I'm not so sure about that, he is definately finished with the course of study, but it's still up to the Supe to give both the degree and the commission. Obviously the commission requires the degree. Like HH said, I have a feeling he will still get some "punishment" and that likely will be no degree. The academy can and will hold your credits hostage. I had a classmate who finished everything, save the last PRT (obviously not the exact same situation), and was sent packing. No credits were initially transfered, and he had to fight quite hard to get them. All because he made it known, that he felt it was unjust that he not at least get a degree if not a commission (again, obviously not the recommended course of action)

This is why you need to videotape every chick you have sex with. That way when they accuse you of rape you just pull out the tape. Of course you'd catch some flak for videotaping someone without permission blah blah but its better than going to prison for "raping" a girl.

To dog hump my last comment, you especially gotta watch out for females in the navy. I know two cases where females werent doing so hot and then all of a sudden a sexual assault case or something along those lines comes along and their slate gets wiped clean. Bottom line cover your a$$

Hmmm, that's interesting. I had a buddy in the same situation. He then attended a civilian school for a semester and got his degree. Then he went to OCS.

The defendant won't be exactly fading... He will be sentenced in the next couple of days for violating a restraining order and conduct unbecoming. Lamar Owens evidently went alllll the way up to 7-4 to talk to her about the case, definately a bad idea. As for XYZ, JKL had messages sent over AOL instant messenger from her telling Lamar to come over, and this wasn't the first time she was involved in this sort of thing. The defense called in character witnesses to emphasize the fact that this girl had intimate knowledge of many a midshipman. Now we have a ruined career and a tarnished view of the Naval Academy to thank this girl for.

The military court system did its job and he is not guilty of rape, period.

I did want to point out that the IM piece was never proven, technical experts could find no evidence of it. But only that, what the hell kind of statement is "this wasn't the first time she was involved in this sort of thing"? It is crap like that discourages women from ever coming forward in the first place to report rape. While I know there is instances where a woman falsely make accusations of rape and sexual harassment, you can't discount a woman's case because you heard about 'stuff' she did in the past. The rumor mill at military schools is not the most reliable thing, to say the very least. I seen examples of both false and valid accusations, let law enforcment and the courts work it out (it worked in Whidbey recently).

It is not a "rumor" if the girl is talking about it with her friends, and it is not her "past" when it is happening on a regular basis. This girl got around. Alot. And you will just have to take my word for it. It's not a rumor. They brought this up during the case, and as you said "the military court system did its job and he is not guilty of rape."

As far as Lamar being the only one that stands the chance of getting in trouble, that is a complete false. Several mids are getting hammered for things like drinking in the hall and some of that has already happened. The girl is not "immune", and if she chooses to stay she will probably be charged with alcohol related conduct offenses. What you read in the papers, and what actually takes place may be very different. The academy is working very hard to paint this picture in the least negative light that they can.

I don't know this girl or the situation, but...

There's always girls who are unstable enough that after a few drinks, they can be coerced into doing something they don't want to do. They just have no idea how to protect themselves... whether it be a senior frat boy or a star QB. Seen it before.

Is it rape because she went along with it? Is he taking advantage of her because she's emotionally screwed up?

It shouldn't happen at the academies, but (again, secondhand gouge) in a near all-male environment, a lot of women tend to be well-used...
