I've never really had any problems to speak of due to the military clause and breaking the lease. I've always given my landlords plenty of heads-up of when I should be expecting written orders. So long as I have written orders a couple months out from moving, I give them written notice with a copy of my orders. Of course, I let them know up front when I sign the lease that I'm smarter than they are and if they try to fvck me, I'll fvck them back harder. Funny, never had a problem. :D

Yes... but P-cola and API don't work quite that way. Expect your landlord to be understanding, if they deal with a lot of military.... but I'm in API right now. I've been told I'll probably be required to report to Vance for Primary within 72 hours of my graduation from API. I graduate on June 16th... as of today (22nd of May) I still have no orders. This is apparently common... I'll hopefully get my orders a week or so before my arrive-by-date.

I've given my apartment complex thirty days notice... but, I may actually be living in a hotel if they keep me here longer than I've been "promised by my LT".

Did you request Vance or did they just throw that at you?

Be that as it may, it's a lot easier to deal with a problem if the appropriate verbiage is spelled out in the rental agreement, which is a contract, and agreed to by both parties. The alternative could involve attorneys and long delays, especially if a less than well informed landlord decides to fight you on it. Having a law (SCRA) on the books doesn't render obsolete the rental agreement military clause, it just provides the legal backing and legitimacy for them. I wouldn't sign a lease, nor have one of my tenants sign one without it.

Brett

You're right--there could be problems and delays if a landlord isn't fully aware of a servicemember's rights under the SCRA. But (and correct me on this if I'm wrong) lease clauses don't need "legal backing and legitimacy." That is, anything agreed upon and signed to by the two parties is fully enforceable, and therefore the language in a rental agreement could very easily be more restrictive than the law allows. For example, SCRA covers the breaking of lease agreements for PCS or deployment of more than 90 days. If you (this is especially applicable to single guys) sign an agreement with a "military clause" that stipulates dissolving the lease only upon receipt of PCS orders, then you've signed away some of your rights under the law. This could also apply to the rules for notification of pending orders, move-out dates, deposit refunds, etc...Again, correct me if I'm wrong, but the signed lease would take precedent over the law, would it not?

Before you rent double check your orders for perdium entitlement

I got down here in April and tried to rent a place as a Geo-Bachelor since the BOQ has no room... Thankfully I never signed a lease... If you have follow-on orders to Primary and API is just a TDY, then there should be another set of accounting data on your orders, if there is then you are entitled to Perdium... The catch is that you can't sign a lease you have to stay in a hotel the whole time, they need your receipts when you file your travel claim at your ultimate duty station... The perdium rate is up to $68.00 a day for lodging and $50.00 a day for food...

If you are not sure just ask the PSD rep during the indoc brief and they will give you the details on how to get your money...

I want to live by myself in P-cola while I'm there for API. All I need is something basic. A bed room, head, a kitchen. How much should expect to spend for rent? As a corollary, how much would power and water be for a place like that?

Yes, I could BUT I want to collect BAH. Beyond that, I'm not betting on being able to live in the BOQ. It is often full, yes? That being said, in addition to my original question, is easy to find space in Q for A-pool/API?

No, it is not easy to find space in the Q for A-pool/API. It is often full. Especially this time of year when everyone is reporting for API. With that being said, it couldnt hurt to ask and see if theres anything availabe. Also, I have a classmate whos been chillin at a hotel near base until we graduate next Friday. So you dont HAVE to find an apartment or house if you know you wont be in the area after API. He's heading to Corpus.

Good gouge. How much would a one bed room apt cost w/ utilities? along those lines, you find out your primary location soon after you check into API, yes?

I lived in Fairfield Lakes off Hwy 98 - they were understanding and didn't punish me whatsoever for giving them like 14 days notice.

In a city where people show up asking for available apartments for that day, it isn't hard to refill some place when a stud leaves on short notice.

What I would be careful of, though, is the distance to Whiting. If you get sent to Whiting Field, and live near NASP, and Whiting is within the range stated in SCRA, you've got no standing to break the lease (and good luck getting your landlord to make an exception for that).

I currently live in a one bedroom apartment near base (Sandlewood on 98). Its $510 per month with no utilities. It has some visible hurricane damage but I have seen worse. When I was looking for one bedroom apartments, the cost ranged from $500-700. Its a good deal because i got some money left over from BAH for all the yuengling i drink. ;)

Not really. When you check in you put your number one pick. Depending on what the situation is you may or may not get it. And of course, you could always get volunteered for Vance. You pretty much won't find out FOR SURE when you start until the Thursday before you start. I was on the list to start 3 times, but got bumped each time for various reasons.

In my class, nobody found out until week 4 (of 6). Official orders didn't arrive until three days before graduation. One guy in my class ended up having to eat a half months rent. Other than that, I have not known anybody that had any trouble breaking their lease.

Be advised though, that if you live by mainside for API then select Whiting for Primary, there are no PCS orders and no authorized move. Whiting is less than 50 miles from mainside, but it is too long a commute for my tastes. This happened to me, but it was no big deal. I gave notice (politely), commuted for a few weeks, then moved.

I dont understand why you would want a one bedroom apt though?? Roommates are the way to go. Its WAAAAAAAAAY cheaper (pocket $500+ every month) and its nice to live with the folks you'll be studying with, drinking with, etc. I've gone through 3 navy roommates and all of them were pretty cool dudes who passed down awesome gouge. There are a bunch of postings in the G-dunk in flt mgmt of ppl looking for roomies. Unless you enjoy being "that guy" who sits in the corner and doesnt talk to anyone and eats lunch by himself. If this is you, much luck gangsta.
