AH64D aviator, all that act does is to let Army warrants have the same rules as commissioned officers. I have been in 20 years but I don't have to retire until 2030 because my time for mandatory retirement reset when I became commissioned 10 years ago.
That only applies to continuing active duty time. Your other active duty time is still active duty time. We honestly aren't trying to give you a bad answer. Trying to come up with different ways to beat the system isn't going to work. Active duty time is active duty time. It doesn't matter what your rank was at the time. Simply ask for a waiver and see what happens. You are spending too much time trying to beat the system instead of spending time to use the system to your advantage.
